Private security personnel also have the same rights as other Indian citizens. Unlike policemen and other law enforcers, they do not have any special rights. Private security personnel have to ensure that people follow the law in the place where they have to work. He can assist the police in maintaining law and order. Therefore, it is important for every private security industries employee to understand the legal aspects of his job.
Right to personal security (Section 96-106)--- The right to personal security can be of a person, where he cannot immediately take the help of the police, then he himself can take the help of private security to protect his property.
The following precautions should be taken while exercising the right to personal security------
Not causing harm to anyone unless necessary to protect oneself or property.
The right to private defense does not apply if the police have time to go.
Verbal conversation, altercation/simple trespass has no bearing on the right to personal safety.
Disproportionate or excessive unnecessary force is not required in the exercise of the right to personal defence.
The following circumstances may occur while exercising the rights of private security
Situations like sudden death or injury etc. may occur.
Abduction or escape
Wrongful imprisonment
sexual harassment
Acid attack
Robbery and theft
